1. Purpose and Scope
GARP (Global Auctions for Recovered Paper) is a digital platform designed exclusively to facilitate commercial connections and negotiations between producers, traders, brokers, and buyers of recovered paper for recycling, through an online auction system.
By using the platform, users fully accept these Terms and Conditions. If you do not agree, please refrain from using GARP.
2. Nature of the Platform
GARP operates as a commercial matchmaking and auction tool. It is not a contracting party to any transactions carried out between users (buyers and sellers). Therefore:
- GARP does not sign or assume contracts of sale or purchase.
- GARP does not own, hold or physically handle the materials listed on the platform.
- GARP does not organize or manage transportation, logistics, or physical documentation.
- GARP is not a fiscal agent, environmental operator, customs intermediary, or regulatory body.
The final contract is entered directly between the seller and the awarded buyer, who bear full legal and commercial responsibility for the execution of the agreement.
3. Commission and Invoicing Terms
- Use of the platform implies acceptance that GARP’s administrator will invoice 2€ or $ per cubic meter commission to the seller for each awarded lot sold through the platform.
- This commission becomes payable only after the seller has confirmed receipt of payment from the buyer.
- GARP is not responsible for collecting payments between parties, but may suspend or remove accounts in cases of non-compliance.
4. Data Protection
GARP fully complies with applicable data protection laws, particularly the General Data Protection Regulation (GDPR).
- Personal data collected during registration and use is processed exclusively for the platform’s operational and technical purposes, and is never shared with third parties without explicit consent.
- Users retain the right to access, rectify, delete, or oppose the processing of their personal data, and may request full account deletion in compliance with legal standards.
5. Liability Disclaimer
GARP and its administrators shall not be held liable under any circumstances for:
- Non-performance or breach of contract by any party.
- Quality disputes, discrepancies in weight, documentation issues, or transport-related matters.
- Financial losses, penalties, taxes, or any burdens derived from the transaction.
- Violations of environmental, customs, or legal regulations by users of the platform.
By agreeing to these terms, the user expressly waives any liability claims against GARP, its administrators, or collaborators, arising from disputes or failures between platform participants.
6. Jurisdiction
In the event of disputes, the courts of the seller’s country shall have jurisdiction, unless both parties voluntarily accept GARP administrator arbitration as an alternative method of resolution.
7. Amendments
GARP reserves the right to modify these Terms and Conditions at any time. Any updates will be published on the platform, and continued use implies acceptance of the new terms.
